บทคัดย่อ

วิจัยเรื่อง “การพัฒนาระบบยุติธรรมชุมชนเพื่อส่งเสริมวิถีชีวิตของกลุ่มชาติพันธุ์อย่างยั่งยืน” เป็นงานวิจัยเชิงคุณภาพ เก็บข้อมูลโดยการสัมภาษณ์เชิงลึก (Deep Interview) และสนทนากลุ่มบุคคล (Focus Group) บุคคลที่เกี่ยวข้องอันได้แก่ ประธานศูนย์ยุติธรรมชุมชน คณะกรรมการศูนย์ยุติธรรมชุมชน เจ้าหน้าที่รัฐที่เกี่ยวข้องตลอดจนผู้นำชุมชน ชาวบ้านกลุ่มชาติพันธุ์ในพื้นที่ตำบลแม่นะ อำเภอเชียงดาว จังหวัดเชียงใหม่ โดยมีวัตถุประสงค์ดังนี้ 1.เพื่อศึกษาระบบยุติธรรมชุมชน การระงับข้อพิพาทโดยศูนย์ยุติธรรมชุมชนตำบลแม่นะ อำเภอเชียงดาว จังหวัดเชียงใหม่รวมถึงกฎหมายต่าง ๆ ที่เกี่ยวข้องตลอดจนหน่วยงานที่มีอำนาจหน้าที่รับผิดชอบ และมีบทบาทสำคัญต่อระบบยุติธรรมชุมชน 2. เพื่อศึกษากฎเกณฑ์ จารีตประเพณีท้องถิ่นของชุมชนกลุ่มชาติพันธุ์ในเทศบาลตำบลแม่นะ อำเภอเชียงดาว จังหวัดเชียงใหม่ในการกำหนดวิธีการระงับข้อพิพาทที่เกิดขึ้นภายในชุมชนตลอดจนการเข้าถึงกระบวนการยุติธรรมชุมชนของกลุ่มชาติพันธุ์ 3.เพื่อพัฒนารูปแบบระบบยุติธรรมชุมชนให้มีความเหมาะสมและสอดคล้องกับวิถีชีวิตและความเป็นอยู่ของกลุ่มชาติพันธุ์อย่างมีประสิทธิภาพเพื่อให้เกิดความยุติธรรมอย่างยั่งยืน 
ผลการวิจัยพบว่าศูนย์ยุติธรรมชุมชนตำบลแม่นะ อำเภอเชียงดาว จังหวัดเชียงใหม่ไม่สามารถขับเคลื่อนระบบยุติธรรมชุมชนได้อย่างมีประสิทธิภาพเต็มที่เนื่องจากปัญหาในเชิงโครงสร้างการดำเนินการ ความไม่ชัดเจนและสถานะของศูนย์ยุติธรรมชุมชนภายใต้บทบัญญัติแห่งกฎหมาย กลุ่มชาติพันธุ์ยังไม่สามารถเข้าถึงและมีส่วนร่วมกับศูนย์ยุติธรรมชุมชนโดยพบว่ากลุ่มชาติพันธุ์มีกฎเกณฑ์จารีตประเพณีภายในของตนเองในการระงับข้อพิพาทที่เกิดขึ้นในชุมชน จึงนำไปสู่การพัฒนารูปแบบยุติธรรมชุมชนให้เป็นยุติธรรมชุมชนภายในหมู่บ้านเพื่อเปิดโอกาสให้กลุ่มชาติพันธุ์สามารถนำกฎเกณฑ์ จารีตประเพณีในการระงับข้อพิพาทภายในของตนมาปรับใช้กับยุติธรรมชุมชน เพื่อให้ระบบยุติธรรมชุมชนสามารถขับเคลื่อนดำเนินการต่อไปได้และชุมชนกลุ่มชาติพันธุ์ได้มีส่วนร่วมในกระบวนยุติธรรมเพื่อลดความเหลื่อมล้ำที่เกิดได้

Abstract

A research paper titled “The Development of Community Justice System for support a sustainable way of Ethnic life.” is a qualitative research. The data was collected by in-depth interviews and focus group given by Community Justice Center Committee Chairman, relevant government officials and community leaders in ethnic communities in Mae Na sub-district Chiang Dao District Chiang Mai Province. The purposes of the research are as follows; 1. To study the community justice system. Settlement of disputes through fair communities in Mae Na Subdistrict Municipality Chiang Dao District Chiang Mai Province, including all relevant laws, as well as responsible bodies, have the power and play an important role in the community justice system. 2. To study the rules Local traditions of ethnic communities in Mae Na Sub-district Municipality Chiang Dao District Chiang Mai Province in determining methods for resolving disputes that arose within the community as well as access to the community justice process of ethnic groups. 3. To develop a model of the community justice system to be suitable and effective in accordance with the way of life and the well-being of ethnic groups in order to achieve sustainable justice. 
The results of the study showed that the Mae Na Community Justice Center is unable to operate with full efficiency. Due to problems in the community justice system in a structured, unclear and existence of the Community Justice Center under the provisions of the law. Ethnic groups are not able to access and cooperate with Community Justice Center. They have own customary rules for resolving disputes that arise in their communities. This leads to the development of a community justice model to be community justice in the village to allow ethnic groups apply their internal dispute resolution rules and regulations to justice community. Therefore, the community justice system can operate and ethnic groups participate in the justice system to reduce the inequality.
