Abstract

Abstract This research has objectives to learn and to develop model of restorative justice by participation of community, learning the model management of Mae-Tuen Community Justice, Omkoi District, Chiang Mai Province, and the model management problems affecting the community of the villages residing nearly Mae Tuen Community Justice are Moo 2 Ban Mae-Tuen Noy, Moo 5 Ban Huay-Lor-Duk, Moo 5 Ban Huay DinMor and Moo 3 Ban Mae-Tuen Noi. For the Purpose of qualitative research as the results that Mae-Tuen Community Justice, Omkoi District, Chiang Mai Province initially, cannot use the model of restorative justice by participation of community for management problems affecting community because authority at the Community Justice lacked of understanding into the role for manage the Community Justice. This should be appointment the authority whose have knowledge to deal with problem in community of each other villages thoroughly and should be publicize information to people in community to give them understand into the role of managing at the Community Justice for helping people justice in community. Furthermore, after learned about the problems affecting community of the villages that residing Mae Tuen Community Justice all 4 villages that found the important problems as 1. Drug problem, 2. Battery problem, 3. Land Benefit problem and 4. Debt problem. According to those problems, brought it to find the resolving model by the villages present resolving methods found that each villages have resolving model by using restorative justice similarly, as having community leaders, sub-district headman, village headman of each villages to be the significant leaders, using conciliation method for helping justice, having surveillance system by community, having the rule of the village, having remedy compensation for the offense, having mental rehabilitation for reform, relationship reform. All these things considered as restorative justice that all 4 villager of 4 villages have participated for resolving problems at Mae-Tuen sub-district that MaeTuen Community Justice can bring the result for develop into the management model of community justice. However, central government should be follow up and evaluation the performance and support promote advice the method in practice about resolving problems, law knowledge and increase the way to contact between central government and the community justice in case of problem exists for Mae Tuen community justice can be management for helping people justice.
